Article 1 – Definitions

Ik Ben Aanwezig: The sole proprietorship “Ik Ben Aanwezig”, located at Hessenberg 2, 6511 BT in Nijmegen, the Netherlands.

User: Anyone who purchases a ticket through the Ticketshop provided by Ik Ben Aanwezig.

Terms of Use: These terms and conditions that apply when purchasing tickets via the Ticketshop.

Organizer: The party responsible for organizing the event and offering tickets for sale.

Event: A concert, performance, festival, or any other type of gathering for which tickets are sold.

Ticketshop: The online system developed by Ik Ben Aanwezig that allows users to purchase tickets.

Agreement: The purchase agreement between the User and the Organizer, facilitated by the Ticketshop.

Assignment: The collaboration between the Organizer and Ik Ben Aanwezig, where Ik Ben Aanwezig acts as intermediary in the ticket sales.

General Terms: The terms and conditions that apply to the collaboration between the Organizer and Ik Ben Aanwezig.

Ticket(s): The admission pass(es) for an event.

Parties: Ik Ben Aanwezig and the User.

Mollie: The payment service provider that processes the payments.

Article 2 – When these terms apply

These Terms of Use apply to everyone using the Ticketshop by Ik Ben Aanwezig.

2.2
By placing an order through the Ticketshop, you accept these Terms of Use. This agreement is saved in our system unless you can prove otherwise.

2.3
Any digital communication we send is considered received on the day it was sent. If a message doesn’t arrive due to inbox issues, this is at your own risk as the User.

Article 3 – Using the Ticketshop

3.1
Ik Ben Aanwezig enables you to buy tickets for an event. We act solely as an intermediary, not as the event organizer.

3.2
The Organizer is responsible for the event itself. All information provided about the event comes from them. We do not verify or guarantee its accuracy.

3.3
To order tickets, you must complete a few steps in the Ticketshop. You are responsible for entering correct information. We store this data securely, with your consent.

Organizers may set their own rules, such as age restrictions or specific entry conditions. We are not responsible for these rules.

3.6
If anything goes wrong with the event (e.g., cancellation, poor seating, denied entry), we are not liable — even if the Organizer does not offer compensation.

3.7
Tickets sold through our platform are exempt from the statutory right of withdrawal. That means you cannot cancel your order or claim a refund unless the Organizer explicitly allows it.

Article 4 – Prices and payment

4.1
When you buy a ticket, you pay the ticket price plus service and transaction fees. These additional charges cover the processing and use of our platform.
All prices are shown before payment, in euros and including VAT.

4.2
Service fees are a fixed amount per ticket. Transaction fees are a fixed amount per order. The fees shown during checkout are binding, even if different rates are listed elsewhere.

4.3
If an event is cancelled, you generally won’t be refunded for service and transaction fees. These fees still apply even if you don’t attend the event for other reasons.

4.4
If the Organizer decides to refund tickets (in full or in part), that’s their decision. If we process the refund on behalf of the Organizer, we deduct the service and transaction fees from your refund. We also charge a fixed handling fee of €1 per refunded order. By placing an order, you agree to this. Note: If the Organizer handles the refund themselves, their own conditions may apply. We are not responsible for how they manage this.

Article 5 – Interruptions and misuse

5.1
The Ticketshop is an online service and may occasionally be unavailable due to maintenance or internet issues.

5.2
We are not liable if the Ticketshop is temporarily unavailable, even without prior notice.

5.3
You may only use the Ticketshop for personal use. Using bots, scripts, or scraping data is not allowed. You may also not promote or reuse content from the Ticketshop without written permission.

Article 6 – Intellectual property

6.1
All texts, visuals, and other content in the Ticketshop are owned by Ik Ben Aanwezig or its partners.

6.2
You may only use these for purchasing tickets. Any other use requires prior written permission.

Article 7 – Privacy

Your personal data is processed according to our privacy policy and privacy laws.

You give explicit consent during the ordering process.

Article 8 – Applicable law

Dutch law applies to these Terms of Use and our service.

If any part of these terms is found to be legally unenforceable, we will adjust it to preserve the original intent as much as possible.
